View Full Version : When the box contains duplicate CD's...

I bought the Worms Triple Pack a while back, which comes with 4 cd's - W2 WA WWP and a Worms Blast demo. Well, I didn't get the Worms Blast demo, and instead I got a second W2 cd.:cool:

So now I have 2 W2 discs, presumably by mistake of the manufacturer. Do I have licenses for both? Can I sell one off? Or is it one of those things where if you make a cd for backup purposes you have 2 discs but only the license for one copy of the game?

I own WB, so I'm not upset about not getting the demo.

Why should I? All I do is remove floods of spam from an internet forum. I have no connection with T17 or the publishers of said game.

Plus, I'm doing a degree in engineering, not law :p

Yep, you have the license for both CDs now, as there is no CD key or other copy protection system bound to the game manual (if printed) or the packaging.

I suggest you make a competition on the forum and give it away as a prize.
Sort of an unofficial T17 compo.

I guess in theory you should send the CDs back to T17, explain the facts, and wait for a replacement 4-pack with the demo, as you didn't plan to pay a small amount in exchange for two W2 copies.

That said, the cost to T17 for sorting out said return from the post, organising a new pack, and paying for postage and packing back to you is probably so (comparitively) large that it'd be cheaper for them to just let you have two W2's and the licences for both. I don't know if you could sell it on, though - profiting from an accident sounds unwise (and possibly illegal) to me.

I think(hope) Bonz is right, but I'm still hoping for a response from a Teamster. Either way though, I don't think I plan on getting rid of it because it's quite unique indeed.

There was some offer on - you got an envelope free with your pen if you bought it there. Well, I didn't really care about the envelope, having a drawer full of them, but it was free so I ordered both anyway.
However, when the package came in the post, I didn't have the envelope: instead, there was a second expensive pen, an exact duplicate of the first. I wondered whether I should send it back, but then I thought:

Not meaning to be rude, but surely this is a case of a moral choice as opposed to a personal preference? The question is whether it is better for T17 to have their mislaid CD back than to let you keep it; it's not a question of which you'd rather have. Everyone likes free stuff. Even me. But that doesn't mean you have a right to it if it's a mistake.

Well, you could send that second expensive Parker pen to me!
In exchange for package and postage I'll send you a whole pack of envelopes plus a bunch of cheap ballpoint pens (promotional gifts), should you already have gotten used to more than one pen.

By doing so you could also silence your conscience because of you someone had to pay £50 for two envelopes.

Sorry for late post, not been around for a few weeks, but i know under UK law the Sale Of Goods Act says they are both yours to resell if you want.

I agree that they're both your property to sell.

I would point out that you bought them from Ubisoft (the publisher), not Team17 (the developer).

As far as i know, you now own both copies, regardless of whoever made the mistake...

Not sure about the UK... but in South Africa, if they make a mistake, for example, you want to buy say... THE MATRIX TRILOGY.... and it should be sold for 500 Pounds.... but they mark the price as 50 Pounds... THEY MUST SELL IT FOR THAT PRICE... even though it was a mistake...

The same applies for duplicate disks....

So its legally yours, but if its eating you up. Then Send it to me, so i can give it as a prize for which ever lucky wormers team... Wins the WORMS WORLD CUP.... hehe (well i thought id try... hehe)

I would keep it as a backup to your other copy, always good to have 2 originals.
